Abstract

The book Jaw?rhir al-Kal?m f? Sharh Shar?yi` al-Islam deals with a demonstrative study of various jurisprudential topics according to Shari`ah. It is in a combined style and the passages of the book Shar?yi` al-Islam appear in parenthesis. With the benefit of the Quranic verses and traditions, the author examines the opinions of Shiite jurispru-dents and their arguments and studies the relevant case. The opinions of some Sunnite jurisprudents are also mentioned in some cases.

Addresses of Quranic verses, traditions and opinions of jurisprudents appear in footnotes. The chains of authorities and the texts of traditions are presented briefly and followed by discussions on their significance. In arguing for jurisprudential the author insists on consensus of scholars and the traditions of the Infallibles (`a),

This series contains various jurisprudential chap-ters from £ah?rat (cleanness) to Diy?t (blood-money). The discussions appear in the same orders as the book Shar?yi` al-Islam.

Abstract

This book is vol. 6 of a collection of commentaries on Quranic verses regarding jihad (holy war) and defense. The writer's method is to pay attention to Shiite exegetical and jurisprudential sources and to compare them with those of the Sunnites. According to the writer, subjects such as the means for jihad and its virtue, which he claims are not mentioned in previous books on legal verses, are rendered. On the other hand, such subjects as primary jihad, defensive Jihad, and the authority of the Islamic ruler in war discussed in other books, are not presented here. He also discusses the viewpoints of the Orientalists regarding war and defense. After an introduction to the Concept of Jihad, there are six chapters: The Necessity and Obligation of Jihad, Conditions for Obligation of Jihad, and Its Circumstances and Time, Types of Jihad, Some Islamic Rules for Jihad, Means and Assets of Jihad, Virtue and Superiority of Jihad.

Abstract

The book is the 6th volume of classroom-notes from Ayatollah Sayyid Ab? al-Q?sim Khu'?'s fiqh? (legal) lessons, in Najaf. The lessons are, in fact, commentaries on MuEammad K??im Yazd?’s al-`Urwat al-Wuthq?, which are presented within the framework of Shiite dialectical fiqh (jurispru-dence). The collection is entitled, Mad?r?k al-`Urwat al-Wuthq? and is arranged according to the usual categorization of the Shiite fiqh. The volume contains four chapters on ïah?rat (purity). Part 1 is, in fact, a continuation of the previous volume's discussion on the Purifiers (muïahhir?t). The volume begins with Islam as a purifier. The rest of the topics include: taba`?yyat (subordination), destruction of the actual impurity, istibr?' (confirmation of emptiness) of a jall?l animal, istinj?' (abstersion) with a stone, blood of sacrifice, well-water, tayammum (ablution with sand) after the ghusl al-mayyit (funeral ablution) and istibr?' of man, absence of the Muslim.

Ch. 2 contains criticisms on the opinions of certain Shiite jurisprudents on a number of purifiers and the things that causes impurity, the last two chapters are devoted to the methods for the proof of purity and the rules pertaining to containers.
